OVERVIEW
Welcome to FreeFast.Food! The terms "we," "us," and "our" refer to FreeFast.Food. We operate this platform to provide you with a curated concierge experience (the "Services") โ acting as your personal authorized agent to help you access and fulfill food requests efficiently, and in many cases, completely free through our referral and rewards programs. FidoFinds.Food is a consumer-facing brand operated by FreeFast.Food; these Terms apply to it as well.
You may access the Services through several surfaces, and these Terms apply equally to all of them: our website; our command-line tool (npx orderfood); connected AI assistants and automated clients that order on your behalf via our Model Context Protocol (MCP) endpoint and related integrations; and our messaging concierge, "Fido."
A note on who we are: FreeFast.Food is a demand generation platform. We send real, incremental customers through real restaurant doors. Every order placed through our platform represents a customer visit the restaurant would not otherwise have received โ driving foot traffic, app engagement, loyalty enrollment, and repeat business. We are a restaurant industry ally, not an adversary. We frame everything we do in that spirit, and we invite everyone who interacts with us to see it the same way.
By using our Services, you agree to be bound by these Terms and our Privacy Policy.
SECTION 1 โ ACCESS AND ACCOUNT
By using this site, you represent that you are at least the age of majority in your jurisdiction. You are responsible for providing accurate information so we can complete your requests, and for maintaining the security of your account and any credentials, access tokens, or API keys used to access the Services (including through our command-line tool or AI-assistant integrations). You are responsible for all activity that occurs under your account or through credentials and tokens issued to you. Notify us promptly if you believe your account or any token has been compromised.
SECTION 1A โ AUTOMATED, COMMAND-LINE & AI-AGENT ACCESS
We offer ways to use the Services beyond our website, including a command-line tool (npx orderfood), a Model Context Protocol (MCP) endpoint, and integrations that allow AI assistants and other automated clients to browse deals and place orders on your behalf.
You are responsible for your agents. When you connect an AI assistant or authorize an automated client, you authorize it to act as your agent under the same limited authority described in Sections 3 and 3A. You remain fully responsible for every instruction, order, and payment it submits, exactly as if you had placed it yourself. We are not responsible for actions an AI assistant or automated client takes based on your configuration of it.
Tokens. Access tokens and connection links we issue for these surfaces are personal and confidential โ treat them like a password. You may revoke them at any time, and we may expire, rotate, or revoke them to protect the security and integrity of the Services.
Compatibility and fair use. For security and reliability, we may require a minimum client version and may refuse or limit outdated, modified, or unauthorized clients. You agree not to use automated access to scrape, overload, reverse-engineer, circumvent security, or otherwise abuse the Services.
SECTION 2 โ SERVICE REPRESENTATION AND BRAND INDEPENDENCE
We strive to provide an accurate representation of available items and offers. However, the final preparation, portion size, presentation, availability, hours, and pricing of any menu item are determined solely by the applicable third-party restaurant operator and are subject to change without notice. We use real-time availability technology to surface the best opportunities near you, but we cannot guarantee any specific item or offer will be available at the time of your order.
FreeFast.Food promotions and content are independent and not sponsored, endorsed, or affiliated with any brands or trademarks featured on this site. All third-party trademarks, logos, and brand names are the property of their respective owners and are referenced solely for informational and directional purposes.
Any claim that FreeFast.Food's demand generation activities cause harm to a restaurant brand, its revenues, its franchisees, or its operations is factually unsupported. We generate incremental visits. The economic benefit โ upsell revenue, loyalty growth, repeat customers, increased app engagement โ flows directly to the restaurant operator. We proudly stand behind that value proposition.
SECTION 3 โ ORDERS AND FULFILLMENT
When you place an order, you are making an offer to purchase. FreeFast.Food acts as your authorized agent to facilitate this request. Because we act as your real-time concierge to secure these items immediately, we are unable to accommodate cancellation requests once the fulfillment process has begun.
SECTION 3A โ AGENCY AND LIMITED POWER OF ATTORNEY
By placing an order, you grant FreeFast.Food a limited power of attorney to act as your agent for the sole purpose of procuring and fulfilling food orders from third-party vendors on your behalf. This authorization is strictly limited to the transaction at hand and terminates upon fulfillment or cancellation of that order.
SECTION 3B โ NATURE OF SERVICE; NOT A FOOD VENDOR
FreeFast.Food is a digital ordering service, not a food vendor, food retailer, or food reseller. We do not sell, prepare, handle, store, or take title to any food items. Our Services consist exclusively of operating the ordering infrastructure and fulfillment systems required to submit and manage food orders on your behalf as your authorized agent. Any food items procured through our platform are ordered directly from and fulfilled solely by the applicable third-party restaurant operator. FreeFast.Food assumes no responsibility for the quality, safety, accuracy, or availability of any food item procured through our Services. If you have a food allergy or dietary restriction, confirm ingredient and preparation details directly with the restaurant before consuming any item.
SECTION 4 โ PRICES AND BILLING
FreeFast.Food charges a per-item service fee for use of our digital ordering infrastructure. This fee reflects the cost of operating our ordering systems and fulfillment services โ including real-time availability technology, secure payment processing, platform infrastructure, and customer support โ and is independently determined based on the value of the ordering service delivered, not as a markup on food. Many orders are discounted or fully free through promotions, rewards, or store credit, as described in Section 4A.
To help customers understand the value our service provides, we may display typical third-party retail or menu prices as a reference benchmark alongside our service fees. These reference prices are sourced from publicly available menu information and are provided for informational purposes only. FreeFast.Food does not set, control, or guarantee third-party menu pricing, and displayed comparisons are subject to change without notice.
Our service fees vary by item and reflect customer-segmented pricing โ a model standard across the digital services industry. Customers who derive greater value from our service, such as those accessing higher-value menu items, contribute proportionally more toward the shared infrastructure costs that make the service possible for everyone. This approach allows us to keep our service accessible and affordable across a broad range of offerings while sustaining the platform that powers them.
Prices and promotions are subject to change without notice. You agree to provide current and accurate purchase information and represent that you are authorized to use any payment method provided. You agree to cover all charges incurred at the posted prices, including any applicable taxes or service fees.
SECTION 4A โ STORE CREDIT, REWARDS & PROMOTIONAL OFFERS
We offer store credit and promotional incentives โ including referral credits, community rewards (such as $1 credits), beta and welcome promo codes, and credits for qualifying actions like creating an account or placing your first order.
Store credit. Store credit is a promotional benefit. It has no cash value, is non-transferable, cannot be redeemed for cash, and may be applied only toward orders on the platform. We may set expiration dates on unused credit and may decline to combine ("stack") certain offers.
Referral program. You may earn store credit for referring others to the Services, subject to the rules posted at the time. Self-referrals, duplicate or fraudulent accounts, automated sign-ups, and other abuse are prohibited and will void affected credits.
Limits and good-faith use. Rewards are generally limited to one claim per person per qualifying action or channel. We may modify, suspend, or discontinue any offer at any time, and we may withhold, expire, or claw back credit that was issued in error, obtained through abuse or fraud, or earned in violation of these Terms. Repeated abuse may result in suspension or termination of your account.
SECTION 5 โ PICKUP AND LOGISTICS
Our service facilitates the ordering process. To ensure freshness, many items are prepared by the vendor only upon your arrival at the designated location (e.g., via drive-thru or counter pickup). We are not liable for vendor wait times, preparation delays, or your failure to arrive at the vendor location to collect the order. Once an order is confirmed as fulfilled by the vendor, responsibility for the items passes to you.
Where delivery options are offered (including through third-party delivery platforms), fulfillment is complete once the order is collected by the delivery provider, and we are not liable for delays, handling, or issues caused by third-party delivery services.
SECTION 6 โ INTELLECTUAL PROPERTY
Our Services, including logos, text, design, software, and the "Fido" and "FidoFinds.Food" brands, are owned by FreeFast.Food. You may use the Services for personal, non-commercial use only. All third-party trademarks appearing on the site are the property of their respective owners.
SECTION 7 โ THIRD-PARTY LINKS AND TOOLS
We may provide access to third-party tools or links. We do not monitor or control these and provide them "as is" without warranty. Any use of third-party tools is at your own risk.
SECTION 7A โ SECURITY, FRAUD PREVENTION & BOT PROTECTION
To protect our customers and the Services from fraud, abuse, and automated attacks, we use security technologies including the hCaptcha service to verify that interactions with our forms and Services are genuine. We may suspend, limit, or refuse access that we reasonably believe to be fraudulent, abusive, or automated in violation of these Terms.
This site is protected by hCaptcha and its Privacy Policy and Terms of Service apply.
SECTION 8 โ PRIVACY
Your submission of personal information through the platform is governed by our Privacy Policy. Data is processed through secure infrastructure solely to ensure order fulfillment and service stability. We do not sell your personal information.
SECTION 8A โ COMMUNITY, MESSAGING & REWARDS
FreeFast.Food operates community and messaging channels, which may include a Discord server, a Telegram bot (@freefastfoodbot), and accounts on platforms such as Instagram, Facebook, TikTok, X, and YouTube, as well as communications by email and SMS text message. By voluntarily joining a channel or contacting us โ including by messaging our bot, using a slash command, responding to a keyword prompt such as "freebie," or opting in to email or SMS โ you acknowledge that you may receive deal drops, rewards updates, order notifications, and community announcements from us through that channel.
Rewards. We offer store credit incentives for joining our community channels and for other qualifying actions, on the terms described in Section 4A. Rewards are issued as store credit to your freefast.food account, are limited (generally one per person per channel or action), and are non-transferable. We reserve the right to modify or discontinue reward offers at any time.
Opting Out. You may opt out of communications at any time by leaving the applicable channel, blocking or unfollowing our accounts, using the unsubscribe link in our emails, replying STOP to SMS messages, or using the /stop command in our Telegram bot. Opting out stops future outreach through that channel and does not affect any store credit already issued to your account. Our SMS program is described in more detail in our Privacy Policy.
No High-Frequency Messaging. We send deal drops, order notifications, and reward updates only. We do not send unsolicited bulk messages or sell access to your contact information to third parties.
SECTION 8B โ AI-ASSISTED INTERACTIONS ("FIDO")
Our concierge "Fido," along with certain support replies, content, and communications, may be generated or assisted by automated systems and artificial intelligence. We strive for accuracy, but AI-generated responses can contain errors or omissions. Nothing provided by Fido or our automated systems constitutes professional advice (including legal, medical, dietary, or financial advice), and any quoted item, price, or availability is informational only and is final solely at checkout with the applicable restaurant. For allergy or dietary concerns, see Section 3B.
SECTION 9 โ DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY
THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. FreeFast.Food does not guarantee that your use will be uninterrupted or error-free.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, FREEFAST.FOOD AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCTS PROCURED THROUGH THE SERVICES. OUR TOTAL CUMULATIVE LIABILITY TO YOU SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO FREEFAST.FOOD IN THE NINETY (90) DAYS PRECEDING THE CLAIM.
SECTION 10 โ INDEMNIFICATION
You agree to indemnify, defend, and hold harmless FreeFast.Food and its partners, officers, directors, agents, and employees from and against any claim, demand, liability, damage, loss, cost, or expense (including reasonable attorneys' fees) arising out of or related to: (a) your breach of these Terms; (b) your violation of any applicable law; or (c) your use of the Services in a manner not authorized by these Terms.
SECTION 11 โ DISPUTE RESOLUTION; BINDING ARBITRATION; CLASS ACTION WAIVER
11.1 Talk First. Before anything formal, reach out. We genuinely want to make things right. Contact us via the chat or contact form on our website with a description of your concern. We will respond within 30 days and do our best to resolve it without lawyers or arbitrators.
11.2 Binding Arbitration. If we cannot resolve it informally, any dispute arising out of or relating to these Terms or the Services shall be resolved exclusively through binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court.
11.3 No Class Actions. All claims must be brought in your individual capacity. The arbitrator may not consolidate more than one person's claims and may not preside over any class or representative proceeding.
11.4 Waiver of Jury Trial. You and FreeFast.Food each waive any right to a trial before a judge or jury.
11.5 Opt-Out. You may opt out of this arbitration agreement by submitting written notice via our contact form within 30 days of first accepting these Terms. Opting out does not affect any other provision.
11.6 Severability. If any portion of this Section is found unenforceable, it shall be severed and the remainder shall continue in full force.
SECTION 12 โ GOVERNING LAW
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to conflict of law principles. Any disputes not subject to arbitration shall be resolved exclusively in the state or federal courts located in Texas.
SECTION 13 โ CHANGES TO TERMS
We reserve the right to update these Terms at any time. Changes will be posted on this page with an updated date. Continued use of the Services after changes are posted constitutes acceptance of the revised Terms.
